Till last year EB 3 would get additional visa from the leftovers of ROW, both EB2 and EB 3-I would benefit from the ROW visia, now all the visas are going to EB2, so i agree with you, there is little hope for EB 3.

Why are there no repurcussions if USCIS admits that they were incorrectly allocating the visa earlier. they can suddenly change the rules and everybody keeps quiet....strange.

Thats USCIS - Uncertain Surreptitious and Careless Institution to Select future immigrants.

    fyi..

When ever you start working on EAD (filled I-9 form??)..then technically H1-B status will get invalidated...

PS:there are lot of posts here that discussed on the same...for the above source of information.

It would have been amazing if senator added 10K for each recaptured EB VISA. That would have given 1B dollars for the border security(If only senator wanted to help the so called product developing H1Bs).

You need to live in reality...it can be 10K for GC application to pay for more patrols on the mexican border but no recapture....

thank you bala, you guys are awesome. now give chance to other members to contribute. :D

Libra, my personal target is not far away. I am going to stop soon.

GCNaseeb, sunty, ivgoodluck, akhilmahajan and our special guest bala, thank you so much for your contribution.

Sorry, I had to go and see the gun-smith to make sure the revolver is ready for our next round. When she heard me tell her about the
few rounds we had. This is what she said "Make sure when you start the next round, the gun is fully loaded to keep it balanced".

So can I have the pleasure of the company of one senior member who will take the last shot?

Keep aside porting the PD between EB3 to EB2.
    Just try this

Say, you wanted to buy tickets to a show or travel, there are more than one counter which is issuing tickets. You have to choose some line at random. Obviously like the people Pallavi79 choose a line which is shorter in length. After some time person observed that other line is moving fast so wanted to jump to that line. Thats fine. If you try to jump into middle of the other line based on your time entered into 1st line. If you are demanding the position...Think the situation??

And after some time if you see EB3 row is runnign fast you will jump back there? Is this a game you think??

kalinga_sena case seems to be the worst.

Besides kalinga_sena and me, looks like gclabor07 and mgmanoj have also been in the US 10+ years and still don't have an EAD. That will be an interesting poll too: 10+ years in the US and still no EAD.

Why does the line on top of this page say

    ****
Goal amount for this month: 10000 USD, Received: 0 USD (0%)
    ****

I guess, last month is about $2500, and previous month is less than $2K.

Any plans in your mind how to get every member pay $1 every month?

I agree, what did I do for IV for the past few months, nothing. Responded to one or two threads. Been very busy at work and was not able to contribute constructively to this organization. I am wondering how many of us are in this same boat, what are we all actually doing in helping the organization from either volunteering, getting more people to open their eyes and recognize a problem and organize and mobilize people. I have been trying for the past 4 years and its not easy and not always successful. To see the leadership team constantly juggling between work and working on different initiatives and putting in self less hours really requires appreciation. Now I think its worth asking ourselves, how much have we done or are willing to do to take us to where all of us want to be IMHO.

wondering how yu came up with a list of contributors.......if i provide my transfer confirmations to IV and still cannot find my name in the list then how will I trust the veracity of yur list.....

....not for an argument but a query

It is not automatic - santb1975 has to manually go through the posts and update the list. Manual error happens - if your/anyone's name is missing, please do post in this thread, the list will be updated as soon as possible (not in the next minute or hour).

Come on people only 11 shots to be fired. (I will take one shot, two already fired). The next person who will pull the trigger is probably a jovial person. He/she has contributed before or will contribute for the first time. He/she thinks we are a bunch of serious people, who will get the job done, but too serious for his/her company.

That is not the case at all. To prove it, here is a joke for you, to make you pull the trigger, amused and probably laughing.

Note: It is impossible to crack a joke and make everyone laughs. Invariably it is offensive to someone. I hope it is not the case here. Also, not everyone likes a particular joke; well the objective here is to make only one person laugh (enough to go to google and pull the trigger). You may have already heard it, but I found it funny. If I dont get contributions for this one; thats fine, I wont try again; this will be the last joke I will post. (I dont want to scare you away).

An old lady takes the limp body of her rabbit to the vet. She pleads to the Dr Please please take a look at my dear Pilu. He is not responding at all. The Dr goes and checks the poor rabbit. Sorry! But your Pilu is dead. No it cant be the case, help me, help me, please do something. The Dr says OK and blows a whistle. A cat come and gets on top of the table where Pilus body is lying. She sniffs the body from top to bottom and shakes her head and leaves the room. The dr looks at the old lady and shakes his head too. Old lady protests and says the dr is not doing a good enough job. The Dr again whistles and in comes a Labrador Retriever. The dog also check Pilu and declares that the rabbit is dead. How much the lady asks the dr holding Pilu very close to her chest. $250 the Dr replies.WHAT $250 TO TELL ME THAT MY DEAR PILU IS NO MORE. The dr replies back in a very calm tone it would have cost you 50 when I told you, but you were not convinced and I had to run a lab report and do a cat scam. $100 each

Hi ind_game, attorney and all readers,

After reading ind_game last quote "God save AC21.....". I have following questions:

    1. Do you know any one (your friend, client) used AC21 and faced same problem? Es
    2. Is it true that AC-21 info don't get updated in the USCIS records?
    3. If yes (2 question), then x-employer I-140 revocation will ALWAYS result in THIS kind of problems (as ind-game is facing)?
    4. To attorneys only: Is AC-21 really helpful or misleading? Asking because if it don't update in USCIS records.

    Please reply.

    thanks,
    waitingmygc

Almost everyone who use AC21 and had their ex employer informing USCIS about the job change has gone through this.

There is no case of AC21 being denied. It is the law, no need to be scared if you did everything right.

RNGC, excellent thread, looks like pessimistic folks have taking this thread for a ride.

America stands to loose in many ways. Here is why..

A study by Kauffman Foundation shows that "an average 13.25-year lag between a key founder’s arrival in the United States and firm formation" - source : http://papers.ssrn.com/sol3/papers.cfm?abstract_id=991327#PaperDownload
Loosing well trained individuals due to frustration with the immigration system or due to expired visa duration is equivalent to outsourcing. impact of outsourcing to the US economy is very well debated these days.

Another Kauffman report shows Immigrants were involved in 25% of the US patents approved in 2006 - Source : http://papers.ssrn.com/sol3/papers.cfm?abstract_id=1008366#PaperDownload
This leads to reverse-brain drain phenomena who's effects to the economy are well documented.

Here is couple of NFAP study about

The impact of immigrant Entrepreneurs and professionals on the US competitiveness:
    http://www.nfap.com/researchactivities/studies/immigrant_entreprenuers_professionals_november_200 6.pdf

    Driving Jobs and innovation offshore:
    http://www.nfap.com/pdf/071206study.pdf

Stalling the career path through GC backlogs will impede the creativity of the individuals and hence dampen their entrepreneurial spirit. It also kills the innovative spirits in the individuals.

Those who feel that "grass is greener on the other side" will jump to the other side irrespective of their GC backlog issues, their criteria is different. But there are many who believes that the American system cultivates innovation and entrepreneurial skills, for them the GC backlog is a drag on their growth.

EB1/2/3 is not a delimiter to innovation, innovation happens at all levels. All EB1's aren't PhD's, there are quite a few PhD's in EB2 and similarly there are quite a few MS folks in EB3 too. By saying US just wants EB1 is utter disrespect to fellow professionals who are not on EB1.

    People,
I am preparing an article for NY times explaining our sufferings! Please contribute your thoughts.

    1. What is America losing because of our prolonged wait for Green Cards?

    2. How people who have green cards are contributing to the country as a whole ?

    3. What if the whole green card process takes less than 3 years ?

Few obvious things are we would have bought a house, gone up in our carrier ladder, spend more and contribute to the economy, our spouse could have started working etc....

I am looking for thoughts and experience other than the above things.

    Hi,

I was following this thread and it has good information.
    I have EB3 labor and I-140 approved with priority date March 2005. I couldn't file my I-485 in 2007.
Recently thru same employer I filed EB2 labor which got approved in Sept 2010. I have filed my I-140 under regular processing. I asked my attorney and he said as I already have one I-140 approved I should file this one under regular processing. USCIS might reject premium processing. Any advice.
My 6th year of H1-B is getting completed on Sept 2011.
Please suggest should I file my I-140 under premium processing? Should I try to convert it???
9 years and VayuMahesh any inputs... congratulations to u both for successful I-140 approval and porting....

    Thanks in advance...
    Hi GeetaRam,

I have not heard any one saying, my I-140 denied because of premium processing (I am not advising anything). It depends on the situation of their own. Ask your attorney and company if you can convert to premium and listen to them what they are saying. Based on their comments and input you can decide. As I-140 has to be supported by company we have nothing much to do except to request them. I wish you best of luck.

    Regards.
