Hi all,
I need some good advice and facts...
My friend's H1-B extension is approved but the stamping (Mumbai consulate) might get denied due to a previous (dismissed) charge for driving with suspended license.
What are the options after that? Can he re-apply for the visa stamping again using the same H1-B approval petition? Can we appeal the decision since it document clearly states that the fine was paid?
Please advise.

My frnds wife came here on H4 and shifted to H! last year. Now she went back to H4 bcos they had a baby.
My question, is
If she wants to get back to H1, does she have to go thru the quota or is she exempted from the quota.

HI All,
I have 3 questions
1)what should be the time period between the Job switch from one employer to another after 6 months of filing of I-485.(AC-21)
2)Is it required to be employed until i get my actual GC ?
3) I am in the period of AC-21 (i.e 180 days completed after my I-485 filing)
If I marry to GC holder . Do i still have to maintain my independent status of I-485 or i can be given some status because of marrying to him..

Hi,
I have been working with a company ABC from April 2007 in India. In Oct 2007 I got my H1B visa stamped for a company XYZ of USA and is valid thru OCT 2010. I took a long vacation here in India and went to USA for the company XYZ and stayed there for 45 days. During the period of stay I got my SSN and also I got one payslip generated for two weeks. Becoz of the market slowdown I had to return back to India and joined the same company ABC in India. Now this company ABC wants to process B1 for me, So is there any problem if I have to apply for B1 and is there any problem in the Embassy about the 45 days I spent in US on H1B while I was employed in a company ABC from April 2007?
Please suggest me on this asap

I am working for a small company on H1B since October 2006. The company had originally filed for full time employment (LCA and I-129) but at the time of hiring offered part time employment. I worked part time till June 2008 and since then I have been working full time. The company however never filed for an amended LCA and/or I-129. My H1B approval was extended last October by another 3 years. I also work part-time for a University on a concurrent H1B.
Will I be deemed out of status for this? What are the implications of this on filing for GC under EB1 or EB2? Is there any way in which this situation may be legally rectified?
Please advise.

I noticed they have a Calls to Action from Groups and Organization on the home page, When i tried to see if there are any Immigration related issues posted There were many like increasing H2A etc but nothing corresponding to Retrogression or GC waiting faced by thousands of immigrants.
There are 100s of bills waiting for Co-sponsors published on this website.
I felt we should do post about the issues faced by Thousands of Legal immigrants who are struck in retrogression or Per country limit.
This may be a good place to put as a number of representatives may view it and it is a good way for us to let the people know of the issues.
Any thoughts........
