Mine was filed in august 2007. It took 45 days for it to get audited and it has ever since been in process, that is close to 7 months after audit response.

Hi,
I need advice from Gurus who have experience or gone through this. I am on H1B with pending I485 and i got married recently. My spouse is on H4.
I have been looking for a job and my employers want to hire me on EAD. If i use EAD, then my wife will be out of status.
Other option is for my wife to get into F1 status.
1. How easy to change the status from H1 to F1?
2. Should i wait to use my EAD till my wife's F1 status gets approved?
3. If the change of status gets denied, will there any problem to her H4 status?
4. Will there be any problem if i add my wife (Assuming she is on F1) to pending I485?

Hi,
My H1B is with USCIS and my employer has received an intent to revoke.
I am planning to go on H4 and my questions are
1) Can my employer file for a new H1B ANYTIME regardless of whether my H1B is revoked or not? I heard that since i am already counted against the cap, it doesnt matter when the H1B is filed, once approved i could start work immediately. Is this true?
Or this can be done only till my earlier H1B is not revoked? And if revoked i will have to file H1B against the 2011 quota and start work from October?

Congratulations IV!! We have reached the 4000 member mark. While this is definetly a milestone, like TO_BE_OR_NOT_TO_BE and ragz4u pointed out, we have a lot more potential...
Now that being said, there is a difference between 'giving' vs 'taking'.. In the last couple of weeks we have had 100's of people register to become members, and yet whenever IV volunteers ask for contribution, less that 1% of the new people come to contribute.. That is a TAKER mentality..
Logiclife had started a thread (http://immigrationvoice.org/forum/showthread.php?t=895)that clearly explains why you should contribute.. we have about 2800 members that are yet to contribute... Folks, While a contribution of a 100$ is not a big deal, even if we contribute 50$ (to start with) and 50% of the 2800 people contribute we would have an additional $70,000. This should not be a big deal..

Hello All,
As per the latest regulations, the employer has to pay for all the labor application cost. My employer has agreed to do my green card, but are little hesitant to pay the cost (due to budget constraint). What legal options/adjustments can I make with my employer so that the cost process is not delayed? Thanks in advance.

USCIS used to have a lot of difficulty raising fees and would only get increases approved every few years. They now raise their fees frequently and have just announced their intentions to do so again. I am transferring my H1B from Employer A to B.
With Employer A, I had my recent H1B extension approved till Oct 31 2011.
I am going to have the period on this transfer as June 1 2009 - Oct 31 2011. (Which will 6 yrs in total on H1B status for me).
I have question on form I-129, "Requested Action" section.
Out of the following options, which one should I "Check":
1. Extend the stay of the person(s) since they now hold this status.
2. Amend the stay of the person(s) since they now hold this status.
Please let me know.

I am at present on non-cap h1b and i have asked an employer to file for a new caped h1b in april 2008.
I have tentative plans of going to india in March end . In case i can't make it before april 1st back to US, can my new emplyer file for my New h1b while i am out side US...???
Is there any rule that, lates i-94 needs to be sent while aplying for h1b..???

I have EB2 PERM and EB3 I140 approved. Since my EB3 PD date is earlier than EB2 PD , my lawyer filed my 485 with EB3 I140.
Is there any way to find from 485 receipt or application which I140 was used for filing ?

I am currently on L1 individual extension in US.
I will be traveling to India shortly for 2 week vacation. I will be attending the visa interview for stamping at Chennai before my return to US.
Can someone tell me/share what are the chances of visa getting stamped? What kind of questions to expect?
I hope that since i am already on extension in US, visa stamping is just a formality at US embassy?
Please let me know ASAP.

They don't verify anything. They ask you to fill in a form I don't remember the form number. I remember they were asking your full name, SSN, Address in US, Country of citizenship, place of birth, your father's and mother's first name.

USCIS has announced that it is working on a rule to create an electronic registration system for H-1B employers subject to the annual cap. Employers would first register an application and be allocated an H-1B cap number and then would file the case. The idea is that employers would need to register to claim an H-1B cap number first and then if they are selected, they then would prepare and file the case.
