Hi,
My employers are considering transfering me to another group company (different name) during the next 1-2 months. My job profile will remain unchanged, but the employer name/address (on paychecks, etc) will be different after the transfer. My I-140 is still pending (filed in Aug 2007 together with I-485 at NSC under EB-3).
I'd greatly appreciate anyone's advice on the following:
a) If I transfer before my I-140 is approved, do I need to notify USCIS in writing? If so, does any specific paperwork need to be filled out? My employers have assured me they will continue to support my I-140/485 under the original company name, for as long as required.
b) If I transfer after approval of I-140 (fingers crossed!), do I need to notify USCIS? Again, is any specific paperwork necessary?

Guys, I need ur suggestion and experiences on my typical situation
I am in the process of going full time with my client.
I have my I-485 Filed in July 2007 & have EAD & AP
I am not in a position to use EAD as I got married after I filed for I-485. I have to stay on H1B to maintain my wife's H4 status.
my Client's Attorney is filing for H1B transfer and is suggesting that I can use EAD to start working as soon as he files for H1B transfer.
My understanding is I will loose H1 status if I use EAD, hence H4 will be invalid.
Was anybody in a similar situation ?
I don't want to take a risk by using EAD and my wife loosing H4 status.
Please advice

Does this really help - Writing letters to senators & congressman to expediate the adjudication process ? Please share your experience if you did so?

Hi
I just got off infopass appt. after talking to someone in USCIS serv center.
was told that the case is in the examination section. He did not give me any details as he said thats all what he sees on the screen.
any one tell me what that means and how long could it before they will adjudicate?

presently i am working on h1b for a tech company. I also have my ead (obtained as a result of july 07 fiasco).
Can i start a company, incorporate a llc or a class c company on my ead? What would be my options?
i know that if i had solely my h1b, i could start a class c company but not work for it(use a gc or a citizen) to do it
my question is that can i still continue on my status quo--ie use h1 for my employer and use ead to start a company, or i have to give up my h1 status? since my wife is on h4, i have to continue on h1b until she gets her ead.

How funny is this? My PERM was filed for Tech lead position and I am getting enquiries for PM position and I can not take it whereas you are trying togo in reverse direction. Anyways... you can not come in reverse direction now. The SOC code for Tech Lead is '"15-1031 Software Applications Engineer" which is definitely different than Computer Systems Manager and I believe logically management stream is altogether different than technical stream. Be very careful and refer to attorney at law before you make the decision.

2 - You can work for multiple employers using EAD. Typically EAD will not have any restrictions other than how long it is valid for.

Thats correct. Once the I-140 is denied all the status' that comes with it goes away. So EAD, AP etc are no longer valid. Keep on extending H-1B and if the I-140 ever gets denied then you guys can move to H status.

Have you signed any document or bond which is valid here in United states, then you might have to consult the lawyer otherwise if it is very staight froward case,
One sided bonds not going to last long in court,

I did not find much information about this subject here. That is the reason for this post.
Any thoughts on transferring from BEC to PERM? I know that some folks in my company who applied recently with PERM got approval in less than a week!
I am wondering if anyone has already tried to transfer from BEC to PERM and what their experience has been?
I know that it is risky as it involves closing the pending case in BEC before opening a new one in PERM. The risk of losing the original PD is very high, especially for those of us with > 6years of H1.
DOL was supposed to get back with more clarification on the subject of transfer after gathering stakeholder comments but have not anything about it from DOL in months.
I did not find much information about this subject here. That is the reason for this post.
