Hi Guys,
A friend of mine from India is getting married to a US citizen here. She is coming here on a Fiancee visa (i believe K or V one of them). Does anyone know how long it takes to get a Green Card if you marry a Citizen?
Any help will be appreciated.
I think it is within 6 months. Check the USCIS website for the I130 petition time frame (CSC).

One can contiue to stay using I-485 receipt without valid I-94. afasik I-797 can be used only if you filed H1 extention after you came back on parolee.
If a person travels on AP, he will get a new PAROLE I-94 which shows expiry date of 1 year from the day he entered on AP. Can the person stay in US AFTER that expiry date and continue working using a valid I-797?

I was laid off in Dec 2009, but severance will stop till early Feb. Now I found two potential jobs. Company A is a corporation in same state, but company B is a university in some other State.
1. How long will take them to transfer my H1B? does the different States matter on this transfer time? I want to make sure which one can submit the H1B transfer before my paycheck stops in Feb.
2. In order to apply for Green Card later, which job is better for Green Card application? I heard university will not help the staff (accountant) for Green Card application. Is that true?

As many readers may know for I-129 that is used for H, L and O Petition has been revised. On December 20, 2010, USCIS informed stakeholders that it will accept previous editions of Form I-129 that are postmarked on or before December 22, 2010. Petitions postmarked on or after December 23, 2010, must include the new Form-129 with a November 23, 2010, revision date or else they will be rejected. This contradicts earlier guidance stating that the last day USCIS could accept previous editions of the form was December 22, 2010.
We hope that this update clarifies some of the confusion regarding the last date the old form can still be used.

Do you have a work permit to enter Canada. A Business visa is not good enough?
Re entry to US every week is going to get increasingly trickier.

You should not be getting paid less than the prevailing wage, that's the important number. A $25,000 reduction is a lot, and suggests that the job has changed. If that's the case, the employer should have filed a new LCA and amended the H-1B.

Does anyone have the latest on labor substitution? I am being offered a pre-approved labor. I will have to switch to a not so good employer for the same. I want to know if there are known rumors at this moment about cancellation of pre-approved labor.

My I-140 & I-485 applications had been transferred to VSC for receipting and later my I-485 was transferred back to TSC. But my I-40 has been pending at VSC for close to 6 months with no signs of any processing. VSC seems to be still processing Apr 06 applications while TSC has been processing I-140 under 6 months. Realistically my application should have stayed at TSC, but was transferred to VSC due to receipting delays and balance the workload. But now my application is stuck at VSC. For no fault of mine, my applications ended up in VSC. There is no signs of PP starting anytime soon. Can I lodge a complain to ombudsman in this regard? Will they be able to help me? Who do I contact and where can I find all the information to lodge a complaint?

as far as I understand it, you will be eligible for AC21 in feb. As long a they do not withdraw your 140 you should be ok. Just switch to a different employer and invoke AC21 in feb. Disclaimer: consult an attorney to confirm.

bigboy007: As long as you have filled the form given by ASC officer and she has endorsed your FP notice, You are fine. ASC officer was right, single finger print will cover both of your applications. Just relax, I see no issues.

my first PWD was submitted on feb 8 and it came back apr 8. the wage was too high. so a new pwd was submitted on apr 16. it came back today with a proper wage.

When a particular priority date becomes current in the next month's bulletin,say the July bulletin. Does USCIS start looking at the current cases once the July bulletin is issued or starts looking at them from July 1st.
