Hi....
I am having a really emergry question that I need help on.
case:
My Husband was a F1 international student and his F1 service had stopped by his school, but his Visa( China) was expires on July, 2009. Couple months ago, he and I gets married and he is ready for file the green card. But his grandfather is very sick now and he have to go back immedately; however, he didn't file anything at this time. If he having a emergry that need to go back on June , what he can do now? And is he able to come back to US?

I applied SSN 3 week back and planning to go to India for 2 months due to personnel reasons. I am not yet received my SSN.

Unless some political goof up turns, economy seems to be getting brighter and brighter. This might help translate into more jobs and opportunities..

My I-140 got approved and priority date from EB3 got ported to EB2. I read in one of the forum threads that USCIS system would automatically identify that application is current and appropriate action will be taken. Also, I read about initiating interfile process of existing EB2 I-140 (current) with Pending I-485 application (under EB3). I am not sure whether I should wait few weeks before initiating interfile process.
I have given my biometrics in 2007 while filing I-485. Will USCIS send appointment for Biometrics again ?

If there is a anti immigration material in any website, instead of pointing a link to it, it is better to copy paste the content here. This way we can avoid HITs to the website. The reverse could be done for pro-immigrant news/articles etc where the link will help us to post comments on the news website directly.

I have seen references that if there are different I-140 apps approved per family, there is a possibility of going for the 485 stage separately. Also I have seen posts stating that one can go for AOS and the other for CP.
How do you communicate to USCIS that for one you are doing AOS and the other you are doing CP, with reference to the 485 stage? When does this really happen?

I got my PERM labor approved yesterday, for applying I-140 were can I find the processing dates for I-140? I mean specific to Country? Because, if I go to https://egov.uscis.gov/cris/jsps/Pro...viceCenter=NSC the processing time for "Skilled worker or professional" is April, 1 2008, does this date apply for all? Thanks in advance.

For the first time I think IV was put ahead of AILA/AILF in immigration issues when it mattered. I think finally immigration community can have sigh of relief because immigrtaion community is not represented by a bunch of attorneys who make money on immigration issues (which are legitamate or not ) but by a grass roots organization of immigrants. Congrats to IV and its members in resolving july visa bulletin fiasco. Long live IV

I need to apply for an extension for 3 more years, i get my first H1B from 10-04-2008 to 08-31 but i'm not sure about the process to extend my H1B, i dont now if i need re-enter in the visa lottery like the first time.
Extensions don't count against yearly cap numbers. So, you can apply for the extension 6 months before your current petition expiry (feb 2011).

There is a mistake in my 485 cover letter. The letter states that I am EB3 but actually I am EB2.
Will this cause any problem? Will USCIS deny my case? Please note we included I-140 approval form in the file.

Your cover Letter is not a USCIS document. As long as the actual application forms and supporting documents are good you should have nothing to fear.

I'm Canadian who've worked in US for the same employer under L1 Blanket for almost 3 years, my current L1B will expire at July 2011. I heard a lot of L1 extension get rejected recently, I wonder if I can have a fresh L1B petition (I-129) with another 2 year, then go to US-Canada border and turn around with the fresh L1B petition, so I can stay in US for anther 2 years.
My only concern is that, do I qualify the '1 year working at foreign branch within 3 years prior to admission to US' requirement? considering I've been in US almost 3 years already.

I just found this forum and it is really nice place to get some practical information from people gone through all this. I will be applying for Adjustment of Status as I am getting married to a US citizen and I am not. The only thing that I cannot figure out for now is:
Do I have to fill out I-130 and submit it along with the I-485? I am currently on H2B visa in the usa, never been out of status just extended my stay a couple of times. I have my I-94. Also my H2B will expire end of September. Do I have enough time by then to fill out my papers so I do not get out of status. I am getting married by the end of August.

My company applied for PERM for me. Short of asking our HR/attorney everyday what is the way to check status.
Its applied just last week and but I can resist the urge to check the status already (anxious because I need H1B extension soon). Any advice is appreciated. thanks.
