Hi
My fiancee is currently on H1B (got through the 2008 quota) and I am currently on F1 visa status. She is planning to go on an F2 as my dependent.
Please clarify these doubts:
When she gets a job while she is on F2 and the new employer processes her H1B does she have to go through the whole process of H1B as a new visa issue (annual cap) or is it like an H1B transfer?
Once going from H1B to F2, is there a certain time period one has to wait before one can go back to H1B?
If the F2 application is pending, is it possible to reapply from F2 back to H1B during that period?
Any help will be greatly appreciated.

Hi,
I want to go outside of US and return back on December 8, 2010 while my passport expires on June 6, 2011. I will be entering on an advance parole document obtained as an I-485 applicant. As such at point of entry my passport will be expiring in less than 6 months (5 months 28 days). Please let me know if the passport needs to be valid for 6 months at the time of entry or this restriction does not apply to entry based on parole.

Hi,I have filed H1B during August 09 ..my priority dates became current in Sep 09 and I have filed for AOS -485 /EAD ..Should I cancel my H1B or will it automatically get canceled once I receive my EAD ?Please suggest.

We like to share that the H1B cap is extremely close to being reached. The count as of December 15, 2009 is 64,200. This is 1300 cases more than the count from December 11th. This count is very close to the total cap of 65,000 which is actually somewhat reduced by numbers allocated under trade agreements. We continue to watch this very closely, and will provide updates until the FY 2010 cap is reached.
We suggest to act quickly to avoid last minute embarrassment as H-1B Cap may soon be cease to exist.

One of my long-time paralegals at Siskind Susser, PC is Esther Schacther Fridman. Esther, who grew up here in Memphis, is the granddaughter of Holocaust survivors. In 2005, she married Benny Fridman, an Israeli who was on a work visa in Memphis at the time. Hi Guys,
I have been sailent follower of the IV and it has been an great help i have got from IV for my GC gourney. I have received the CPO email for me and my wifes 485 of friday, but nothing after that no approval email or welcome notice email, is this is common?

They can pay you in anything they like for immigration purposes. US immigration doesn't care what you get paid when you're outside the US.

Does any one knows why EB2 India is not approving in comparison to 2006.
As my understanding that USCIS should process application in FIFO and PD.
My PD is Feb 2005 and when I talked to CS he told me that everything is cleared and my case should be approved .
He told me to call after 68 days ( don't know why) if my case is not approved till then.I am seeing peoples with 2006 PD are getting there GC .

My wife couldn't get Xray on a failed TB skin test, because she was pregnant at the time we filed our 485. Our priority date will be current in August.
Should we wait for a RFE on her medicals? Or is it possible to go ahead and do it, and send an update to USCIS?

I am panning to file I 485 before July 31st. Also I am planning to go on vacation to India around Aug 10th. The trip to India is unavoidable.
Experts please answer the following question:
1) Both me and my wife are on H1 and it has to be stamped. Will I 485 Filing have any adverse impact on the H1 Stamping ?
2) Will leaving the country for vacation without the I 485 receipt have any impact on the I 485 process.

I got green card through marriage. My wife is a US citizen and I came here legally and was in legal status(F-1) before getting married. We got married in August 2005. I applied for green card following year and finally got my card approved March 2008. I got a conditional residence which expires March 2010. I did all paperwork myself. My wife recomend me for an attorney for removal of condition. Attorney tells me that USCIS screwed up and sent me a conditonal residence card as under,"Immigration Marriage Fraud Amendments Act of 1986 (IMFA) on November 6, 1986. INA � 216, 8 USC � 1186a","Under IMFA, an �alien spouse� who obtained the status of an alien lawfully admitted for permanent residence by virtue of a marriage contracted less than 24 months before the date of admission is considered to have obtained such status on a conditional basis."
Now he wants me to send the green card back to USCIS as at the time of approval of my petition my marriage had passed more than two years!
I am confused. I need a second opinion.

Do not do this - please stop playing around with USCIS rules. There are sometimes unfortunate circumstances where folks lose status (e.g., OPT -> H1b) or are kept in dark about their H1B status by employers but for folks who break the law in a way that you are suggesting, I believe they should be punished.

One can contiue to stay using I-485 receipt without valid I-94. afasik I-797 can be used only if you filed H1 extention after you came back on parolee.
If a person travels on AP, he will get a new PAROLE I-94 which shows expiry date of 1 year from the day he entered on AP. Can the person stay in US AFTER that expiry date and continue working using a valid I-797?

I am filling out an LCA online for an employer who is hiring someone as an H-1B transfer. I am using iCERT and had a question as I go through the process:
Part E. Attorney of Agent Information
16. Law firm/Business FEIN:
This sections asks me for my law firm tax ID number. However, I am a solo practitioner so do not have a TIN or EIN - I use my SSN for taxes etc.
If I leave this part blank, or put N/A will this make them deny my LCA? I called their help desk, but am waiting (who knows how long) for them to respond.
