This is turning out to be TRUE.

Past week, I made this comment and some people made fun of it. But, it's turning out to be true. They are now fully focusing on EB3 and I think they will continue to do untill they finish all Eb3. Once they reached last quarter then they will make EB2-I/C current and distribute those spill-over visas across EB. They don't have to make EB3-ROW current to give some spill-over to EB3-I. What ever will be left at the end of quarter will be spilled across EB's.

I am expecting lot of REDs on this one.

    Thanks,
    MDix

That is not true, my lawyer who is very influential and he has some good contacts he told me that this year spill-over would be different form last year. I was stupid so didn’t believe him about July 2007, and paying it for now for not having EAD.

I know this is hard to believe especially if something comes from lawyer.

    Thank's
    MDix

you are right, and it would be nice, however
it's clear our funds are not exactly astronomical.
so let's concentrate on building them up first along with our membership.
then we can sit back and worry about how much more is really needed....
For instance, I am sure maintaining this web site must cost money. How much more money is needed for our main cost drivers until March (for instance) --- by which time we are hoping some action will be taken?

Adding more members will always help because it produces a bigger impact on senators/ house reps

Dear "colleagues in faith" :-), there is only one way to change the things with this immigration trap - we have to win the public opinion!

Currently 350,000 highly qualified professionals working for this country are in a legal limbo which continues for years. Our current legal status is that of slaves. Yes, slaves! Nowadays it takes anywhere between 5 - 10 years from applying to receiving of a GC. We cannot change our employers within this period, the members of our families cannot work (at least legally) and our spouses lose their professional carrier; if our kids get in college they are treated as "aliens" (full tuition, no student loans, no scholarship); the loans we get are with higher interest rate (for "protection"); at the borders we are treated as "intruders" etc.

The average Americans are honest hardworking people. If they are aware of the immigration problems faced by 350,000 hardworking professionals in this country, they will raise their voice and will help for resolving of this issue. They just need to know that. I believe that in addition to talking to senators etc., we have to find ways our issues to reach the media - newspapers, magazines and so on. An article in Times may lead to a lot of positive changes in the immigration system.

Be careful in choosing the wording. Don't bad mouth the agencies or talk about scandals and security lapses. Just concentrate on how this fiasco affected you and millions of people legally waiting in line

I am talking to my immigration attorney right now to get all paperwork filed concurrently.
My attorney say's EAD's are generally approved within 90 days. Will that be before my I-140 is approve or doesn't that matter?

    Regards to all,

Are you sure it was Atlanta and not Chicago?. Your timeline suggests it was applied in Chicago.
My company applied for PERM ALC EB-2 category at Atlanta on 18th June 2007, got it approved on 20th June. Received hard copy on 26th June.

Pause and take a moment to rejoice. Then turn all eyes to processing dates.

    TSC July 17 2007
    NSC July 28 2007

    My online status shows
"On August 17, 2007, we received this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS..........................."
My recepit date was however July 2nd 2007. Are they processing my application or they go by received date of 8/17?
can someone explain how this works?

I can understand attorney's thinking: H1B is good to have. If there is no reason for its revocation (i.e applicant is still working for H1 sponsor), then there is some level of protection for you. Another aspect is a legal status. While EAD gives you an opportunity to continue work legally if I-485 is denied, it does not protect your legal status (accumulate more than 180 days of unlawful presence and you lose eligibility to adjust status and are a subject to re-entry ban). Having H1B gives you a protection in this case. But if H1B is revoked, I-485 is denied and a person does not have EAD, then there is no escape. It's nice to have both, but maintaining EAD should be the priority.

Typically, if someone is doing a AC21 jump + H1b transfer, it means that the h1b gets transferred to the new employer and the new employer is the h1b petitioner. If the h1b is based on an approved 140 - the beneficiary gets it for 3 years and unless the person is completing his 3 years with the new employer when the 140 revoke happens, the h1b is still valid unless the new employer decides he will cancel it or the person is layed off and thats when the person is in deep trouble because he/she does not have EAD. Correct me if I am wrong. H1b revocation by ex employer may not affect the candidate because candidate already did a transfer

One thing for sure USCIS do likes April fools day a lot as this the date they usually pick when the retrogress. This proves that a fool named DOS in love with April fools day.:)
I don't know if anybody has noticed it but the dates for EB-2 for VB October 2007 was April 1, 2004 and for VB October 2008 is April 1, 2003. That is a retrogression of 1 year - not good.

mbawa.. It is always nice to sit on the side and blame it all on the leaders here. First thing you have to remember is that these poor/great folks (poor for representing people like you and great for working for representing all immigrant hopefuls) are really working for YOU and me. It is quite convenient to blame others than doing things yourself. If you think you are any better, why not come up with your USEFUL/GREAT ideas and see if the IV core respects those ideas or not. Lobbying or not, when the government is ready to think about CIR or immigration in general, I am pretty sure that IV can make OUR voice heard. Got the point?

Problem is not the members but the overall stratergy. I understand ur emotions but certainly we need change and action. Without aggressive stratergy that can punch the noses of people against our agenda, we will not be successful. As I said - this is not personal at all. I know some of core people very well and they are competent and bright boys. This has to do with overall stratergy and we need to be bit more agressive .Without a new team which will bring in a coordinated effort & energy into this , we will not make it. CIR may get passed and other immigration categories may benefit at our cost if we don't change our course . Thanks for sharing your thoughts.

Cornyn Seeks Interim Relief For America's Technology Companies
Introduces Amendment Aimed at Protecting U.S. CompetitivenessThursday, July 19, 2007

WASHINGTON Building on his efforts to protect U.S. competitiveness, U.S. Sen. John Cornyn, ranking Republican on the Immigration, Border Security and Citizenship subcommittee, today introduced an amendment to the Higher Education Reconciliation, currently under consideration by the Senate, which would strengthen employer access to skilled employees.

A key part of the American economy is our ability to innovate. Yet, today, our countrys technology companies are facing an impending crisis which requires critical interim relief, U.S. Sen. Cornyn said today. USCISs announcement this year that the cap for H-1B workers was met in just one day, coupled with the recent July announcement that employment-based visas were no longer available for those with advanced degrees, makes clear that industry needs interim relief today until we can return to comprehensive immigration reform. This amendment will go a long way to help out businesses that are the life-blood of the U.S. economy and I hope my colleagues will join me in supporting it.

Specifically, the Cornyn Amendment would allow the Department of State and DHS to recapture unused employment-based visas. This is not an increase in employment-based numbers but rather, a direction for the agencies to use all the visa numbers that are available today. These visa numbers will be distributed to nurses and physical therapists and aliens with extraordinary ability, advanced degrees, and needed skills. In addition, the Cornyn Amendment also includes a one-time H-1B increase of 115,000 (up from the 65,000) for FY 2008 only.

So maybe the H-1B provision killed it??
    .
